General Terms of Sale

2. Purpose and scope

bmdecor.es is the online boutique of BM Decoración. It sells premium paint and wall coverings from a selection of brands (including Benjamin Moore, Farrow & Ball and Little Greene) for delivery in Spain and Portugal or in-store pickup at our Marbella showroom. We are an independent retailer; the brands we stock are owned by their respective rights holders and we are not affiliated with any shop directly operated by the manufacturer.

We currently ship to the Iberian peninsula and the Balearic Islands. Shipments to the Canary Islands, Ceuta or Melilla are subject to customs clearance and the IGIC / IPSI tax regime, and the Azores and Madeira fall outside the peninsular zone; please contact us for a quote.

3. Acceptance of these terms

By placing an order or creating a customer account, you accept these general terms in the version published at the time of the transaction. We keep a record of your order and of the version of the terms that applied. Material amendments are notified by email and on this page; orders already in progress are governed by the version in force at the time of placement.

4. Contracting process

Pursuant to Article 98 of Royal Legislative Decree 1/2007 (TRLGDCU) and Royal Decree 1906/1999, the steps to conclude the contract are:

1. Add the desired product, finish, container size and quantity to your Bag.
2. Review the Bag — lines, quantities, subtotal, VAT breakdown, shipping fees and total are shown before confirmation.
3. Select the shipping method (home delivery or Click & Collect at Calle Dublín 21) and enter the required contact and address details.
4. Accept these terms, the Privacy Policy and, for non-essential cookies, the consent banner.
5. Authorise payment via Stripe. Payment is processed under Stripe's own terms; we never access or store your full card number.
6. You'll receive an order acknowledgement by email within 24 hours, pursuant to Article 28 LSSI-CE.

You can correct input errors at any step before authorising payment by editing your Bag or going back. After payment, email info@bmdecor.es within 24 hours to report any error; we will assist as long as the order has not yet shipped.

5. Prices and VAT

All consumer prices on bmdecor.es are quoted in euros and include Spanish VAT at 21%, as required by Article 60.2.c TRLGDCU and Law 37/1992. Trade accounts (Pros) can view net prices with the VAT broken out. Shipping fees are likewise shown VAT-inclusive.

We reserve the right to refuse or cancel any order containing an obvious or material price error, even after order acknowledgement, in which case we will refund any amount charged in full via the same payment method.

Different paint manufacturing batches may show micro-variations in tone and finish. We strongly recommend ordering the full quantity needed for a project in a single purchase. On-screen colour rendition is indicative only; we recommend ordering a 60 ml sample before committing to a full container.

6. Payment

We accept payment via Stripe Payments Europe Ltd (PSP), supporting Visa, Mastercard, American Express, Apple Pay, Google Pay and — in Spain — Bizum and SEPA direct debit when enabled. Every transaction is authenticated using Strong Customer Authentication (3-D Secure) as required by PSD2.

Invoices are issued as PDFs and emailed after the order ships. B2B customers can enter their VAT / CIF / NIF during checkout to receive a full invoice; intra-Community reverse-charge applies when relevant.

7. Shipping and delivery

Delivery zones, fees and timeframes are detailed in our Shipping & Returns Policy. The statutory maximum delivery period under Article 66 bis TRLGDCU is 30 days from the order date; in practice we deliver within 24-48 hours in Marbella and within 3-5 business days across the rest of the Iberian peninsula — except Orac Décor wall décor, which ships factory-direct from the manufacturer and carries a separate delivery fee (see our Shipping & Returns Policy). Risk of loss transfers to the consumer at the moment of physical delivery (Article 66 ter).

8. Right of withdrawal

Consumers (B2C) have a right of withdrawal of 14 calendar days from receipt of the goods, pursuant to Articles 102-108 TRLGDCU and Directive 2011/83/EU. To exercise it, complete the model form below or send any unambiguous declaration to info@bmdecor.es within 14 calendar days. Goods must be returned within 14 days of that notice, in their original condition and with seals intact where applicable. Refunds are processed via the same payment method within 14 days of receiving the goods (Article 107).

Exceptions to the right of withdrawal (art. 103 TRLGDCU) expressly applicable to paint products:

• Custom-tinted paint (art. 103.c) — paint tinted to a specific colour code, base or finish requested by the customer; non-returnable.
• Opened paint tins or wallpaper rolls (art. 103.e) — products that, for hygiene or safety reasons, cannot be returned once unsealed. A value reduction may apply if the seal is broken.
• Wallpaper cut to measure from larger stock (art. 103.c) — non-returnable as goods made to consumer specifications.

Model withdrawal form (Annex I-B Directive 2011/83/EU): To: BM Decoración, Calle Dublín 21, 29670 Marbella, Spain — info@bmdecor.es. I hereby give notice that I withdraw from my/our contract of sale of the following goods: [order number, products]. Ordered on / received on: [dates]. Name of consumer: [name]. Address of consumer: [address]. Signature (only if this form is sent on paper): [signature]. Date: [date].

The direct cost of return shipping is borne by the consumer unless we expressly waive it. Goods must be sent to Calle Dublín 21, 29670 Marbella, Spain.

9. Statutory conformity guarantee

Under Articles 114-127 TRLGDCU as amended by Royal Decree-Law 7/2021, consumer goods are covered by a three-year statutory conformity guarantee from delivery. To file a claim, write to info@bmdecor.es with your order number and photographic evidence. Remedies follow the statutory hierarchy: first repair or replacement, then proportionate price reduction or contract termination. Any commercial guarantee offered by the manufacturer is in addition to, not in place of, this statutory guarantee.

10. Trade customers (Pros)

Trade customers register a Pros account by providing their VAT number and billing entity. Trade orders are governed by these terms with the following adjustments:

• Consumer protections (14-day right of withdrawal and 3-year statutory guarantee) do not apply.
• Custom-tinted paint and project-specific orders are non-returnable.
• Volume pricing, project quotes, and 30-day payment terms are available for approved accounts.
• Unopened, untinted stock returns may be accepted within 30 days, subject to a 15% restocking fee.

11. Liability

We apply reasonable diligence to ensure the accuracy of information on the site. We do not exclude liability for wilful misconduct, gross negligence, death or personal injury. To the extent permitted by law, we limit liability for indirect or consequential damages arising from use of the products. Force-majeure events (fire, flood, strike, supplier failure, public-health emergency, etc.) suspend our delivery obligations for the duration of the event.

12. Intellectual and industrial property

All site content — text, design, source code, layout and images — is the property of BM Decoración or used under licence from the respective rights holders (brand identity of Benjamin Moore, Farrow & Ball and Little Greene). Brand names, colour codes and collection titles are registered trademarks of their respective owners. Reproduction or commercial use without written consent is prohibited.

13. Data protection

Your personal data is processed in accordance with our Privacy Policy, the GDPR (Regulation EU 2016/679) and the LOPDGDD (Organic Law 3/2018). Cookie handling is described in our Cookie Policy, pursuant to Article 22.2 LSSI-CE and the AEPD's 2024 Cookie Guide.

14. Online dispute resolution

Pursuant to Article 14 of Regulation (EU) 524/2013, consumers resident in the EU may submit any complaint relating to an online purchase to the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr. Our contact email for this purpose is info@bmdecor.es. We also hold complaint forms (hojas de reclamaciones) at our physical shop on Calle Dublín 21 under Decree 72/2008 of the Junta de Andalucía.

15. Governing law and jurisdiction

These terms are governed by Spanish law. Disputes with consumers are subject to the courts of the consumer's domicile in Spain (Article 90.2 TRLGDCU). Disputes with B2B customers are subject to the courts of Málaga, Spain.
